What is intellectual property? Who should be interested in intellectual property? What are the risks of not knowing about intellectual property? Ventura attorney, Jim McDermott, discusses intellectual property rights.
Briefly speaking, intellectual property results from creativity (such as patents or trademarks or copyrights). It is a product of the intellect that has commercial value, including copyrighted property such as literary or artistic works, patents, business methods, and industrial processes.
Intellectual property law (with the exception of trademarks) has a purpose to “Promote progress.” Through the process of exchanging limited exclusive rights for disclosure of inventions and creative works, society and the patent holder and/or copyright owner mutually benefit and an incentive is created for inventors and authors to create and disclose their work.
